@timschlomi I think that the moment we stop saying that this is the preferred IDEAL scenario and instead is the preferred PRACTICAL scenario, is the moment we need to consider the practical considerations of implementing such as system.

@timschlomi I think the biggest hole in this plan is the assumption that these trading firms will be any good at efficiently predicting the outcome of a trial. I don't get the sense that ANY trial lawyer has a great sense of the outcome of a case

@timschlomi But in the proposed system in 99% of the time they replace a trial. The defendant has no other recourse. They then need the same protections and rights The publication of this information also would taint future trials in the 1% of cases.

@timschlomi But now they don't have the right to that trial! You are replacing in this system a 100% guaranteed right to a 1% chance at that right. Put it another way a given individual who would have been vindicated at trial by confronting their accuser now is blindly lumped into a class

@timschlomi I'm saying that presuming you can't segregate out the wealth of the individuals at issue, then the average overall stays at some percentage and for the rich it shifts down. You are presuming you can identify the rich by name. I'm saying that's not possible anywhere near reliably

@timschlomi From that point of view, I don't think any of the accused would rather their case be settled by sports-bettors.
